FA231 - Regulatory Compliance - Outside the Financial Aid Office
This course will help participants to interpret the many rules and regulations that are required by educational institutions offering Title IV funding. It will aid in preparing management and faculty in recognizing that compliance is the responsibility of the entire institution and is not just the job of the Financial Aid Office. Course content will also aid the individual in building a "culture of compliance" which will encourage teamwork and secure the cooperation of others on campus.

Course Objectives
Module 1: Compliance Starts with Admissions
- Define "regular student," "approved program," and "matriculation"; and help to define an effective and compliant admissions process.
- Help to create institutional policies and procedures to ensure that all students possess proper high school credentials or an acceptable equivalent as well as developing a procedure to be able to filter out credentials from unaccredited schools and diploma mills.
- Describe the restrictions on compensation structures for admissions personnel and provide strategies for evaluating employee performance and rewarding exceptional performance within regulatory constraints.
- Differentiate between appropriate disclosure of financial aid information to prospective students and inappropriate packaging of financial aid by admissions personnel.
- Define "misrepresentation" and recognize both inappropriate and marginal statements or activities while ensuring that all necessary disclosures are in place prior to enrollment.
Module 2: Academics
- Introduce the concept of "institutional eligibility" and examine the differences and interactions between state licensing rules, accreditation rules, and federal regulations.
- Examine the mandatory components of any "Federal Academic Progress" standards.
- Create institutional policies that are both compliant and pedagogically appropriate.
- Differentiate between the various types of student discontinuances and properly record dates of attrition in compliance with federal regulations.
Module 3: Student Accounts (Bursar)
- Develop and assess internal processes for the timely and accurate accounting for all federal funds.
- Evaluate institutional processes for the posting of federal funds to an individual student's account. Identify the circumstances under which excess funds must be refunded, and processed in a timely manner.
- Define the notification requirements for federal loan disbursements and develop proper procedures for notifications.
- Recognize "potential internal control", "separation of function", and "conflict of interest" situations and be able to assess the how to correct problematic issues.
Module 4: Campus-Wide Compliance Issues
- Develop institutional policies and procedures to protect the privacy of student information both electronically and within personal interactions.
- Create institutional policies and procedures to comply with federal regulations regarding student and employee safety including the publication of an Annual Security Report (ASR).
- Utilize technology to prevent the unlawful copying and distributing of copyrighted material from the institution's computer network system.
- Outline required "consumer information" and build compliant systems for the distribution of this material to the community.
Module 5: The Roles of Compliance Team Members
- Define institutional objectives and staff responsibilities within the context of a "federal compliance team" and build structures to promote and monitor compliance throughout the institution.
- Educate all faculty and staff and monitor compliance across campus, including serving in a leadership role among the management group within the team.
- Identify specific regulatory issues within departmental areas of responsibility, while serving in a support role for fellow managers as a member of the "federal compliance team."
- Recognize professional employee and departmental compliance responsibilities, and be able to identify and report non-compliance to management personnel.
